1. Introduction
Welcome to PhysioPrep AI. These Terms of Use govern your access to and use of the PhysioPrep AI platform, including our mobile applications available on iOS and Android, and our web dashboard.
By creating an account or using any part of our platform, you confirm that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use our platform.
These terms form a legally binding agreement between you and PhysioPrep AI. Please read them carefully.
2. Definitions
- Platform: the PhysioPrep AI website, mobile applications, and all related services.
- We, us, or our: PhysioPrep AI and its operators.
- You or user: any person who accesses or uses the platform.
- Content: all text, questions, explanations, AI-generated responses, images, and materials available on the platform.
- Subscription: a paid plan granting full access to the platform.
- Trial: the 14-day free access period provided upon account creation.
- Educator: a verified physiotherapy professional offering consultation sessions through the platform.
- Session: a paid one-on-one video consultation between a user and an educator.
3. Eligibility
To use PhysioPrep AI you must:
- Be at least 18 years of age.
- Be a qualified or trainee physiotherapist, or a person preparing for a physiotherapy licensing examination.
- Have the legal capacity to enter into a binding agreement.
- Not be prohibited from using the platform under any applicable law.
By creating an account, you confirm that you meet all of the above eligibility requirements. We reserve the right to suspend or terminate any account that does not meet these requirements.
4. Account Registration
4.1 Creating an Account
To access most features of the platform, you must create an account by providing your full name, email address, and a password. You agree to provide accurate, current, and complete information during registration and to keep this information updated.
4.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with any other person. You agree to notify us immediately at info@physioprep.ai if you become aware of any unauthorised use of your account.
4.3 One Account Per Person
Each account is for individual use only. You may not create multiple accounts or use another person's account without their explicit permission.
4.4 Account Accuracy
You must not impersonate any person or entity or misrepresent your identity or qualifications when creating an account or interacting with educators on the platform.
5. Free Trial
5.1 Trial Period
Upon creating an account, you are granted a 14-day free trial with full access to all platform features. No credit card is required to start the trial.
5.2 Trial Limitations
The trial begins on the date your account is created and ends at midnight on the 14th day. After the trial expires, your access is automatically downgraded to a restricted free state unless you have subscribed to a paid plan.
5.3 Post-Trial Free State
After the trial expires, without a paid subscription you will be limited to a maximum of 4 practice questions per day, no access to AI explanations, no access to full analytics, and no access to mock exams. This restricted state is intentional and not a technical error.
5.4 One Trial Per Person
The free trial is available once per person. Creating multiple accounts to obtain additional free trials is a violation of these terms and may result in permanent suspension of all associated accounts.
6. Subscriptions and Payments
6.1 Paid Plans
Full access to PhysioPrep AI requires a paid subscription. We offer monthly and multi-month billing options. Current pricing is displayed on the subscription screen within the platform.
6.2 Payment Processing
Payments are processed by third-party payment providers: Razorpay for users in India, Stripe for users in Australia and internationally, and PayPal for users in the rest of the world. By subscribing, you agree to the terms and conditions of the applicable payment provider.
6.3 Billing and Automatic Renewal
Your subscription will be billed at the start of each billing cycle and renew automatically at the end of each billing cycle unless cancelled before the renewal date. You authorise us and our payment providers to charge your selected payment method for the applicable subscription fee.
6.4 Price Changes
We reserve the right to change subscription pricing. We will provide at least 14 days notice before any price change takes effect. Your continued use of the platform after the effective date of a price change constitutes your acceptance of the new pricing.
6.5 Refunds and Failed Payments
Subscription fees are generally non-refundable except where required by applicable consumer protection law. If you believe you are entitled to a refund, please contact us at info@physioprep.ai within 7 days of the charge. If a payment fails, your subscription may be suspended until the outstanding amount is settled.
7. Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at info@physioprep.ai. Cancellation takes effect at the end of your current billing period. You will retain full access until that date. Cancellation does not entitle you to a refund for the unused portion of the current billing period unless required by law.
8. Platform Content and Intellectual Property
8.1 Our Content
All content on the platform including clinical questions, AI-generated explanations, study recommendations, course materials, design elements, logos, and software is owned by or licensed to PhysioPrep AI and is protected by copyright and other intellectual property laws.
8.2 Licence to Use
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform for your personal, non-commercial exam preparation purposes only. This licence does not permit you to copy, reproduce, distribute, modify, adapt, create derivative works, use content commercially, screen-record, scrape, systematically extract content, share login credentials, or provide others with access to your account.
8.3 AI-Generated Content
Explanations and recommendations generated by our AI systems are provided for educational purposes only. They are based on general clinical knowledge and are not a substitute for professional clinical advice, peer-reviewed medical literature, or official examination guidelines.
8.4 Your Content
By submitting any content to the platform including chat messages and feedback, you grant us a non-exclusive, royalty-free licence to use that content to operate and improve the platform. You retain ownership of content you create.
9. Acceptable Use
You agree to use PhysioPrep AI only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
- Use the platform for any unlawful, harmful, or fraudulent purpose.
- Attempt to gain unauthorised access to any part of the platform or its systems.
- Interfere with or disrupt the platform or its servers.
- Use automated tools, bots, or scripts to access or scrape the platform.
- Upload or transmit viruses, malware, or other malicious code.
- Harass, threaten, or abuse any educator or other user.
- Attempt to reverse-engineer, decompile, or disassemble any part of the software.
- Use the platform to provide exam preparation services to third parties without our written permission.
- Share, publish, or distribute exam questions or AI explanations from the platform publicly or commercially.
Violation of these acceptable use provisions may result in immediate suspension or termination of your account without refund.
10. Educator Consultations
10.1 Nature of the Service
PhysioPrep AI facilitates connections between users and independent educators who offer one-on-one consultation sessions. We do not employ educators and are not responsible for the quality, accuracy, or outcome of any consultation session.
10.2 Booking and Payment
Consultation sessions are booked and paid for through the platform. Payment is collected at the time of booking. By booking a session, you agree to the consultation fee displayed at the time of booking.
10.3 Cancellation and Refunds for Sessions
- Cancellations made more than 24 hours before the scheduled session time are eligible for a full refund.
- Cancellations made less than 24 hours before the scheduled session time are not eligible for a refund.
- If an educator cancels a session, you will receive a full refund within 5 to 10 business days.
- No-shows by the user are not eligible for a refund.
10.4 Educator Independence and Conduct
Educators are independent professionals. Their opinions, recommendations, and advice during sessions represent their own professional views and do not constitute the official position of PhysioPrep AI. You agree to conduct yourself professionally and respectfully during all consultation sessions.
11. Gamification and Rewards
The XP points, levels, and badges earned through platform activity have no monetary value and cannot be exchanged for cash, credits, discounts, or any other tangible benefit unless we explicitly state otherwise.
Daily streaks are tracked based on your local timezone as detected by the platform. We are not liable for streak resets caused by device timezone changes, internet connectivity issues, or technical errors. We reserve the right to modify, suspend, or discontinue any gamification feature at any time without notice or liability.
12. AI Features and Limitations
12.1 Educational Purpose Only
All AI-powered features including clinical explanations, the recommendation engine, the AI tutor chat, and personalised study plans are provided for educational and exam preparation purposes only. They are not a substitute for professional clinical training, supervised practice, or official examination preparation materials.
12.2 No Guarantee of Accuracy
While we strive to ensure the accuracy of AI-generated content, we cannot guarantee that all explanations, recommendations, or responses are error-free or up to date with the latest clinical guidelines. You should always verify clinical information against authoritative sources.
12.3 No Clinical Advice
Nothing on PhysioPrep AI constitutes clinical advice for the treatment of patients. The platform is designed exclusively for exam preparation and must not be used as a clinical decision-making tool.
12.4 Chat History
Your AI chat conversations are stored in our database to provide you with chat history. You may request deletion of your chat history at any time by contacting us.
13. Disclaimers
PhysioPrep AI provides tools and resources to help you prepare for physiotherapy licensing examinations. We do not guarantee that use of our platform will result in passing any examination. Examination outcomes depend on many factors outside our control.
We strive to maintain high availability of the platform but do not guarantee uninterrupted access. The platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
14. Limitation of Liability
To the fullest extent permitted by applicable law, PhysioPrep AI and its operators, directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or business opportunities; failure to pass any examination; damages arising from reliance on AI-generated content; or damages resulting from unauthorised access to your account.
Our total liability to you for any claim arising out of or relating to these terms or your use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim.
15. Indemnification
You agree to indemnify and hold harmless PhysioPrep AI and its operators, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses including legal fees arising out of or in any way connected with your use of the platform, your violation of these terms, or your violation of any rights of another person.
16. Termination
You may close your account at any time by contacting us at info@physioprep.ai. Closing your account does not entitle you to a refund of any unused subscription fees.
We reserve the right to suspend or terminate your account at any time and without notice if we determine that you have violated these Terms of Use, engaged in fraudulent activity, or if your account poses a risk to the platform or other users. Upon termination, your right to access the platform ceases immediately. We may retain your data for a period as outlined in our Privacy Policy.
17. Changes to These Terms
We may update these Terms of Use from time to time. When we make material changes, we will notify you by email and through a prominent notice within the platform at least 14 days before the changes take effect. Your continued use of the platform after the effective date of any changes constitutes your acceptance of the updated terms.
18. Governing Law
These Terms of Use shall be governed by and construed in accordance with applicable laws. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the applicable territory.
19. Severability
If any provision of these Terms of Use is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of the remaining provisions.
20. Entire Agreement
These Terms of Use together with our Privacy Policy constitute the entire agreement between you and PhysioPrep AI with respect to your use of the platform and supersede all prior or contemporaneous communications and proposals, whether oral or written.
